An appeal against the decision of Isle of Anglesey County Council to refuse retrospective planning permission for an agricultural shed and milking parlour together with the construction of a slurry pit, two silos at Plas Llanfihangel, Capel Coch has been allowed and planning permission has been granted.
The planning application was refused by members of Isle of Anglesey Council’s Planning Committee on grounds of unacceptable effects on landscape character and visual amenity and unacceptable effects on the living conditions of neighbouring occupiers, with particular regard to noise.
In addition to successfully appealing the Council’s decision, Cadnant Planning successfully obtained a full award of costs against the Council. This was on the basis that the Council behaved unreasonably and that the unreasonable behaviour has caused the appellants to incur unnecessary or wasted expense in the appeal process.
The Planning Committee decided to refuse the application contrary to the advice of their professional officers who had produced a written report analysing the effects of the proposal. In defending the appeal, Council Members gave little weight to factual evidence and information provided by the appellants.
